Overview

These Terms of Service (“Terms”) govern your access to and use of the website located at https://tonnomonster.com, including any related content, features, tools, products and services (collectively, the “Services”).

The Services are operated by TonnoMonster Inc., operating as TonnoMonster (“TonnoMonster”, “we”, “us” or “our”). Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and services to you.

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, do not use the Services.

Nothing in these Terms limits or excludes any right or remedy that cannot be limited or excluded under applicable consumer protection, sale of goods, privacy or other laws.

Eligibility And Accounts

You must be at least the age of majority in your province, territory, state or country of residence to make a purchase through the Services. A parent or legal guardian may allow a minor to use the Services under their supervision, but the parent or guardian remains responsible for that use.

You agree to provide accurate, current and complete information when creating an account or placing an order. You are responsible for keeping your account credentials confidential and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.

You may not sell, transfer, assign or license your account to another person.

Product Information, Vehicle Fitment And Availability

We make reasonable efforts to ensure that product descriptions, specifications, compatibility information, images, prices and availability are accurate. However, display settings, photography, packaging updates and manufacturing changes may cause minor differences in colour or appearance.

For vehicle-specific products, you are responsible for selecting the correct vehicle year, make, model, cab configuration, bed length, trim and any other fitment details requested on the product page. Fitment tools and search filters are provided as guides. The product page and the specific variant selected at checkout form part of your order.

If you are uncertain about compatibility, contact us before placing your order. We will make reasonable efforts to assist you. Nothing in this section limits our responsibility for inaccurate product descriptions, incorrect fitment information supplied by us, defective products or any other obligation imposed by applicable law.

Product photographs may show vehicles, accessories or installation examples that are not included with the product. Please review the product description and included-components list before ordering.

We may update product information, discontinue products, limit quantities or restrict sales to particular geographic areas. These changes will not alter an order that we have already accepted unless we contact you and obtain your agreement or provide a cancellation and refund.

Orders And Acceptance

When you submit an order, you are offering to purchase the selected products under these Terms. An order confirmation or payment authorization does not necessarily mean that we have accepted the order.

We accept an order when we send a shipment confirmation, provide notice that the order is ready for pickup, or otherwise expressly confirm acceptance. We may decline or cancel an order before acceptance for reasons including product unavailability, suspected fraud, payment issues, an obvious pricing or product-information error, shipping restrictions, quantity limits or suspected unauthorized resale.

If we decline or cancel an order after payment has been authorized or collected, we will notify you using the contact information provided and will void the authorization or issue a refund to the original payment method, as applicable.

Please review all order details before submitting your order. You may request a change or cancellation before shipment, but we cannot guarantee that the request can be completed once processing has begun.

We will provide an electronic order confirmation containing the material details of your transaction. Please retain it for your records.

Retail purchases made through the Services are intended for personal, family, household or legitimate business use and not for unauthorized resale or export. Approved wholesale transactions may be subject to separate written terms.

Prices, Taxes And Payment

Unless otherwise stated, all prices are displayed and charged in Canadian dollars (CAD).

Applicable sales taxes and shipping charges are calculated and disclosed during checkout before you submit your order. Shipping charges are governed by our Shipping Policy.

Prices, promotions and discounts may change without notice before an order is accepted. A promotion may be subject to additional terms. If promotional terms conflict with these Terms, the promotional terms apply to that promotion.

You represent that you are authorized to use the payment method submitted with your order and that the billing information you provide is accurate. Payment processing may be performed by Shopify Payments or another third-party payment provider and may be subject to that provider’s terms and privacy practices.

We will not increase the price of an accepted order without your agreement. If an obvious pricing error affects an order, we may contact you before shipment to offer the correct price or cancel the affected item and provide a refund.

Shipping, Delivery, Title And Risk

We currently ship only to destinations described in our Shipping Policy. Orders are subject to address verification, product restrictions, carrier limitations and service availability.

Processing and delivery times are estimates, not guarantees. Delays may result from weather, carrier disruptions, high order volume, address issues, remote-location service limitations or events outside our reasonable control. We will make reasonable efforts to provide updates and assist with delayed shipments.

Unless applicable law provides otherwise, title and risk of loss pass to you when the product is delivered to the shipping address provided in your order or collected by you or your authorized representative.

If a package is lost, arrives damaged or contains an incorrect item, contact us promptly and retain the packaging, shipping label and photographs where available. We will assess the issue and provide the remedy required by our policies and applicable law.

Nothing in this section limits any statutory right relating to late delivery, non-delivery, damaged goods or goods that do not conform to the agreement.

Returns, Exchanges And Refunds

Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms.

Please review the Refund Policy before purchasing. It explains eligibility requirements, return time limits, product-condition requirements, authorization procedures, shipping responsibilities, any applicable restocking charges and refund processing.

Do not send a product back without following the return authorization instructions in the Refund Policy. Unauthorized returns may be delayed or refused where permitted by law.

Our Refund Policy does not limit any mandatory right or remedy available to you under applicable consumer protection or sale of goods laws, including rights relating to defective, unsafe, misrepresented or incorrectly supplied products.

Product Warranties And Statutory Rights

Any express written warranty displayed on a product page or supplied with a product applies according to its stated terms. Warranty coverage may require proof of purchase and reasonable information needed to assess the claim.

Unless the applicable warranty states otherwise, warranty coverage may not apply to normal wear and tear, cosmetic damage that does not affect function, misuse, abuse, accidents, unauthorized modification, failure to follow installation or maintenance instructions, use outside stated specifications, or damage caused by another product or vehicle condition.

These exclusions do not apply where the claimed issue results from a defect in the product, inaccurate instructions supplied by us, or another matter for which liability cannot lawfully be excluded.

Nothing in these Terms replaces or limits any warranty, condition, guarantee or remedy imposed by applicable law.

Installation, Use And Safety

Automotive accessories must be installed, inspected, maintained and used in accordance with the product instructions, stated load limits, vehicle manufacturer guidance and applicable laws.

Before installation, inspect the product and verify the part number, vehicle fitment and included components. Do not install or use a product that appears damaged, incomplete or incompatible. Contact us for assistance.

Some products may require professional installation, specialized tools, drilling, wiring or adjustment. Where you are not qualified or comfortable performing the installation, use a qualified installer.

After installation, check all fasteners, seals, latches, wiring and moving parts as directed in the instructions. Reinspect the product periodically and after severe weather, impact, heavy use or long-distance travel.

You are responsible for operating your vehicle safely and complying with applicable vehicle, road, load, visibility and cargo-securement requirements. This section does not limit our responsibility for a defective product, inaccurate instructions or any liability that cannot be limited by law.

Website Use And Intellectual Property

The Services and their content, including text, graphics, photographs, videos, logos, trademarks, product information, layout, design and software, are owned by or licensed to TonnoMonster and are protected by Canadian and international intellectual property laws.

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for lawful personal or internal business purposes.

Without our prior written permission, you may not reproduce, distribute, modify, publish, sell, license, create derivative works from, publicly display or commercially exploit any substantial part of the Services, except as permitted by law.

“TonnoMonster,” our logos and related names, product names, designs and slogans are trademarks or trade names of TonnoMonster or our licensors. Shopify and its marks belong to Shopify. Other third-party marks belong to their respective owners.

Third-Party Services, Tools And Links

The Services may include payment services, applications, tools, embedded content or links provided by third parties.

We do not control third-party websites or services and are not responsible for their content, availability, security or independent practices. Your use of a third-party service may be subject to that provider’s terms and privacy policy.

To the extent permitted by law, we are not liable for loss caused solely by a third party’s independent acts or omissions. This does not limit our obligations regarding third parties we use to perform our contractual or legal responsibilities to you.

Relationship With Shopify

Our online store is hosted by Shopify. Shopify provides the technology platform used to operate the store, but products purchased through the Services are sold by TonnoMonster, not by Shopify.

Questions, claims, returns, warranty requests and other matters relating to a purchase from our store must be directed to TonnoMonster.

To the extent permitted by law, Shopify and its affiliates are not responsible for the products we sell or for our performance of an order. Nothing in this section limits rights that cannot be waived under applicable law.

Because the Services are hosted by Shopify and use third-party service providers, personal information may also be processed by Shopify and other providers as described in our Privacy Policy. Shopify’s privacy information is available at:

By using the Services, you acknowledge that personal information may be processed in jurisdictions outside your province, territory or country, subject to applicable privacy law and appropriate safeguards described in our Privacy Policy.

Reviews, Comments And Feedback

You retain ownership of reviews, photographs, suggestions, ideas and other content that you submit to us (“Feedback”).

By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, publish, translate, distribute and display that Feedback for operating, improving and promoting the Services and our products, subject to applicable privacy law.

You represent that you have the rights needed to submit the Feedback and that it is accurate, lawful and does not infringe another person’s rights. You must disclose any material incentive, discount, free product or other compensation connected with a review.

We may moderate or remove Feedback that is unlawful, fraudulent, misleading, abusive, defamatory, obscene, infringing, unrelated to the product or otherwise violates these Terms. We are not required to publish or respond to Feedback.

Errors, Inaccuracies And Availability

The Services may occasionally contain typographical errors, inaccurate information or omissions relating to product descriptions, compatibility, prices, promotions, shipping charges, delivery estimates or availability.

We may correct information and update the Services at any time. If an error materially affects an order you have submitted, we will contact you where reasonably possible and may offer to proceed with corrected information or cancel the affected item and provide a refund.

We will not use this section to retroactively increase the price of an accepted order without your consent or to limit a remedy required by law.

Prohibited Uses

You may not use the Services:

• for an unlawful, fraudulent or malicious purpose
• to violate any applicable international, federal, provincial, territorial, state or local law
• to infringe intellectual property, privacy, publicity or other rights
• to submit false, deceptive, defamatory, abusive, threatening, discriminatory or obscene content
• to distribute malware or interfere with the security, integrity or operation of the Services
• to impersonate another person or misrepresent your identity or affiliation
• to collect personal information about others without lawful authority
• to send spam, phishing messages or unauthorized solicitations
• to bypass access controls, rate limits, robot-exclusion measures or other technical safeguards; or
• to scrape, copy or extract substantial content by automated means, except for legitimate search-engine indexing, use of tools made available by us, or activity authorized in writing by us

We may take reasonable technical or legal action to prevent prohibited activity.

Suspension And Termination

We may suspend or terminate access to an account or the Services where we reasonably believe that you have materially breached these Terms, engaged in fraud or unlawful conduct, created a security risk, or misused the Services.

Termination of website access does not remove payment obligations already incurred and does not affect an accepted order, refund, warranty claim or statutory right except where the order is lawfully cancelled.

Sections that by their nature should continue after termination will survive, including intellectual property, privacy, disclaimers, limitation of liability, indemnity and governing law.

Website Disclaimers

We aim to keep the Services accurate, secure and available, but we do not guarantee that the website will always be uninterrupted, error-free or free from harmful components.

To the extent permitted by law, the website, general content and optional online tools are provided on an “as available” basis. Product sales are subject to the express warranties, descriptions and policies applicable to the product, as well as all non-waivable statutory warranties, conditions and remedies.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, personal injury or death caused by negligence, breach of a non-waivable statutory obligation, or any other liability that cannot be excluded or limited by law.

Limitation Of Liability

To the extent permitted by law, neither party will be liable to the other for indirect, incidental, special, exemplary, punitive or consequential damages, or for loss of profits, revenue, business opportunity or data, arising from use of the Services or a purchase.

For claims relating to a specific product or order, and to the extent permitted by law, our aggregate liability will not exceed the amount you paid for the affected product or order.

These limitations do not apply to liability that cannot be limited under applicable law, including the matters listed in Section 17. They also do not limit any right to a refund, replacement, repair or other remedy required by consumer protection or sale of goods laws.

Indemnity

To the extent permitted by law, you agree to indemnify TonnoMonster and its directors, officers, employees and service providers against third-party claims, losses and reasonable costs arising directly from your unlawful use of the Services, your infringement of another person’s rights, or your material breach of these Terms.

This section does not require you to indemnify us for our own negligence, misconduct, breach of contract or violation of law.

Events Outside Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control, including severe weather, natural disaster, labour disruption, carrier interruption, government action, supply interruption, cyberattack or widespread telecommunications failure.

We will make reasonable efforts to reduce the effect of the event, communicate material delays and perform our obligations when reasonably possible. This section does not remove any cancellation, refund or other right available under applicable law.

Governing Law And Disputes

These Terms and transactions through the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Mandatory consumer protection laws in your province, territory, state or country of residence may also apply and are not excluded by these Terms.

Before starting formal proceedings, we encourage you to contact us so that we can attempt to resolve the issue. Subject to any mandatory right to bring a claim elsewhere, the courts of Ontario will have non-exclusive jurisdiction over disputes arising from these Terms or the Services.

General Terms

If any provision of these Terms is held to be unlawful or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect.

A failure or delay in enforcing a provision is not a waiver of that provision or any other right.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, corporate reorganization, financing or sale of all or substantially all of our business or assets, provided that the assignment does not reduce your rights under an accepted order or applicable law.

These Terms, together with the policies and product-specific terms incorporated into them, form the entire agreement between you and us concerning the Services and your purchase. In the event of a conflict, product-specific terms or a policy apply only to the subject matter they expressly address.

Headings are for convenience only and do not affect interpretation.

Notices and transaction records may be provided electronically to the email address associated with your account or order, subject to applicable law.

Changes To These Terms

We may update these Terms from time to time by posting a revised version and updating the “Last updated” date.

Material changes will apply prospectively from the effective date stated in the notice and will not retroactively change an order that we have already accepted unless the change is required by law or you agree to it.

Your continued use of the Services after revised Terms take effect means that the revised Terms apply to your future use of the Services.
